It can be subdivided into fine fibers that are strong enough and flexible enough to be spun into material that is a flame retardant, chemically inert thermal and electrical insulator. Asbestos fibers have no detectible odor or taste. They are all solids that do not move through soil and are insoluble in water. Its color will vary according to type, and metallic composition. - In 2002 the import of White Asbestos (Chrysotile) was banned and included in the law.

A question I get asked on a frequent basis by my clients in the early stages is "what is my claim worth"?

Unfortunately, this is almost impossible to answer at the beginning. Many factors are at play, such as liability, contributory negligence, mitigation, and the duration and severity of your injuries.


For more serious injuries, the amounts for ICBC injury settlements vary to a greater degree than less serious, soft tissue injuries.

With respect to less serious, soft tissue injuries, although no two cases are identical in their facts and circumstances, there are some general guidelines as to what to expect. Generally speaking, ICBC uses internal guidelines.


It should be remembered that ICBC internal guidelines are not the law when it comes to ICBC injury settlements, and it is the British Columbia Courts that decide what is the true value of compensation for less serious, whiplash injuries.

There are several grades of whiplash associated disorder (WAD):


1. WAD 0: No complaint about the neck and no physical sign of injury

2. WAD 1: Neck complaint of pain, stiffness, or tenderness, but no physical sign of injury

3. WAD 2: Neck complaint, as well as muskuloskeletal injury

4. WAD 3: Neck complaint, including neurological injury

5. WAD 4: Neck complaint, and a fracture or dislocation



MILD INJURY


This category of ICBC injury settlements generally includes those who have suffered from WAD 1 and WAD 2 injuries, and who have essentially recovered within six months, with no more than two months of total disability. ICBC generally offers in the range of $ 7,500.00 for pain and suffering under such circumstances.


MILD/MODERATE INJURY

In the early 20th century, a man decided to capitalize on the vermiculite he found near Libby, Montana and open a mine to sell this excellent type of insulation to whoever would buy it. This mine was owned by the company the man founded until the 1960s when it was bought by a different, larger corporation. Later on, after the purchase, it became more widely known that the vermiculite in the mine was contaminated with asbestos. At this point, the owner of the mine should have closed it. Unfortunately for the residents of Libby, the mine remained open until 1990.

It is not an uncommon occurrence for a vermiculite mine to be contaminated by asbestos fibers. The two mineral fibers are formed in very similar ways. Because of this, where there is one fiber, there is frequently the other. Once a mine has been contaminated, it is extremely difficult, if not impossible, to remove all of the asbestos fibers from the mine. The biggest difficulty is that the fibers are frequently intertwined in the rocks. This makes it nearly impossible to decontaminate a vermiculite mine. For this reason, once a mine has been contaminated it is usually closed.

The mines in Libby were contaminated by asbestos at some point between their opening and 1990, when they were closed. This means that any person who worked in the mines was likely exposed to the deadly fibers of asbestos without knowing it. Asbestos is known to contribute to or cause a variety of forms of cancer as well as other deadly diseases. 

Many modern mines offer showers and changes of clothes for their employees to use, rather than bring their dirty work suits home to their families. The showers are meant to be a way to allow the miners to remove the soot and dust from their persons before they go home.

This allows them to track less dirt everywhere which, in turn, makes everyone marginally happier at the end of the day.

The mines of Libby did not offer showers or clothes to their employees. This means that every miner took his or her own clothes home at the end of the day, after they had been used in the mines all day. While dirt may be one issue, the bigger issue is that the clothes had been contaminated by asbestos while they were in the mines all day. Once the clothes were contaminated, the fibers were trapped and taken home to be "shared" with other members of the family, particularly those that did the laundry.

Libby has been so contaminated by asbestos that individuals who do not have any connection to the mines are now turning up with asbestos-related disease symptoms. So far, more than 2,600 people have been treated at the free asbestos clinic in town since it was opened. The town's population is only about 2,700.

Asbestos is a fibrous mineral that occurs naturally in the environment and has been used extensively in thousands of products since the last century. There are three kinds of asbestos, known as white, blue and brown. Chrysotile or"White" asbestos is acquired from serpentine rocks and is the most commonly used in industry. In the United States, chrysotile was most extensively used and was present in a wide variety of materials. Amosite or the Brown asbestos is commonly found in South Africa. The third type is"Blue" asbestos or Crocidolite.

The U.S. Department of Health and Human Services, International Agency for Research on Cancer and the EPA have classified asbestos as a known human carcinogen or a substance that causes cancer. In 1989, the EPA issued the Asbestos Ban and Phase Out Rule. This rule was overturned in the case of Corrosion Proof Fittings v. EPA, 947 F.2d 1201 (5th Cir. 1991). Unfortunately, this ruling leaves many consumer products that can still legally contain trace amounts of asbestos.

The position of most health authorities is that if asbestos is left undisturbed and its fibers are not airborne then it poses little danger. However, once fibers become airborne and are “friable” and can be ingested or inhaled then it is dangerous and can lead to asbestos-related diseases such as asbestosis and lung cancer. Why is it so dangerous? One theory has to do with fiber size. Asbestos fibers are microscopic and the body is ill-equip to filter out such small particles. The fibers can them become lodged in the lungs and other organs where they can set the stage for disease many decades later.
